Terms of Service

These terms of service (the "Terms") govern access to and use of the MakeShort service. By creating an account or using the service, you accept these Terms in full.

Purpose and scope

The Terms set out the conditions for accessing and using MakeShort, an online service that generates vertical video clips from videos and horizontal streams. They apply to every user of the service, whether a visitor, an account holder, or a paying subscriber.

Definitions

  • Service: the MakeShort platform available at app.makeshort.io.
  • Publisher: ALSCALE GROUP, a French simplified joint-stock company (SASU) with a share capital of 500 €, registered with the Paris Trade and Companies Register (RCS) under number 109 484 329, whose registered office is located at 61 rue de Lyon, 75012 Paris, France, operating the MakeShort service.
  • User: any person who accesses or uses the service.
  • Account: the personal space created upon sign-up.
  • User content: the videos, files and data imported by the user.
  • Clip: the vertical video generated by the service from a piece of user content.
  • Quota: the limits of your plan, including separate counters for long video imports and short clip imports, as well as duration and generation limits.

Acceptance of the Terms

Using the service constitutes full and unconditional acceptance of these Terms. If you do not accept these Terms, you must not use the service. The publisher reserves the right to change the Terms under the conditions set out below.

Access to the service and sign-up

The service is currently available in private beta, by invitation. Accounts are created via Google sign-in. You agree to provide accurate information and to keep your credentials confidential. You are responsible for all activity carried out from your account.

The publisher may suspend or close an account in the event of a breach of these Terms, in particular in the event of fraudulent or prohibited use.

Description of the service

MakeShort lets you import a video, automatically transcribe it, crop it to a vertical format, add subtitles and export clips ready to publish. Long video and short clip imports use separate counters. Generating clips from an already imported long video does not consume an additional import credit, up to your plan’s clip limit. Unused credits do not roll over when quotas reset.

The service relies on automated processing. Result quality depends in particular on the quality of the imported content. The publisher strives to continuously improve the service but does not guarantee an identical result for every piece of content.

Subscriptions, pricing and payment

The service offers a free plan and paid subscription plans. Full details of the plans and their limits are presented on the pricingpage. The pricing page presents the plans, their prices, quotas and stated file availability periods. Billing periods and quota periods are separate: paying annually does not make all of the year’s credits available at once. Prices are shown in euros, all taxes included: the amount shown is the amount you pay. For customers established in France and for consumers established in another European Union country, this price includes French VAT at the applicable rate. A business established in another European Union country that provides a valid EU VAT number at checkout pays the price shown without VAT, under the reverse charge mechanism. Customers established outside the European Union pay the price shown, without VAT. Tax details appear on every invoice.

Payments are processed by Stripe. Bank details are never stored in clear text by the publisher. Subscriptions are billed monthly or annually as chosen and renew automatically until cancelled. A plan change takes effect under the terms shown during the operation (prorated upgrade, deferred downgrade).

Cancellation and withdrawal

You can stop your subscription from renewing at any time by opening the management portal from your billing area. Cancellation takes effect at the end of the paid period, and you keep access to your plan until then. Cancellation at the end of a period does not give a refund for the remaining time, except where the law provides one, including withdrawal rights and remedies for nonconformity.

Withdrawal from your initial paid subscription

If you are a consumer, you have 14 days to withdraw without giving a reason, starting from the conclusion of your initial paid MakeShort subscription contract. Creating a free account beforehand does not start this period. Automatic renewals of the same subscription do not create a new right of withdrawal or start a new withdrawal period.

The day you subscribe is not counted. If the last day falls on a Saturday, Sunday, public holiday or non-working day, the deadline is extended to the next working day.

To exercise this right, open “Aide facturation” (Billing help) in the application’s Help Centre, then “Exercer mon droit de rétractation” (Exercise my right of withdrawal). You can also email contact@makeshort.io, use the model withdrawal form or send us any other statement clearly expressing your decision. Include enough information to identify your subscription. Sending your statement before the applicable deadline is sufficient. Statements sent in the application receive an acknowledgment by email.

If you withdraw within this period, we will refund all amounts paid for the subscription concerned, even if you have already used MakeShort. We make no deduction for credits consumed, clips generated or time spent using the service. Using the service does not make you lose this right.

Our team processes the refund manually through Stripe, using your original payment method and at no cost to you. We will refund you without undue delay and no later than 14 days after we are informed of your decision. Withdrawal ends the subscription contract concerned; it is separate from cancellation at the end of a billing period, described above.

These rules do not limit any statutory extensions of the withdrawal period, rights arising from a separate new contract, or your other statutory guarantees and remedies.

User obligations and prohibited uses

You agree to use the service in compliance with the law and the rights of third parties. In particular, the following are prohibited:

  • importing or distributing content you do not hold the rights to;
  • importing unlawful, hateful, defamatory content or content that infringes on human dignity;
  • using the service for harassment, fraud or deception;
  • any attempt to circumvent quotas, security measures or technical limitations;
  • reselling or making the service available to third parties without authorization;
  • abusive automated use likely to degrade the service for other users.

You are solely responsible for the content you import and the clips you publish through the service.

Intellectual property

You retain all rights over your user content. By importing it, you grant the publisher a license strictly limited to what is necessary to provide the service (storage, processing, transcription, cropping, generating and delivering clips). Generated clips belong to you within the limits of the rights you hold over the original content.

The MakeShort brand, logo, interface, content and code remain the exclusive property of the publisher. Nothing in these Terms grants you any right over these elements beyond normal use of the service.

Availability, maintenance and liability

We make every effort to keep MakeShort available. Maintenance, updates or technical incidents may interrupt the service. Automated processing can produce varying results depending on the imported content.

These limits do not remove our contractual obligations or guarantees and remedies under mandatory law. If you are a consumer, no clause of these Terms excludes or reduces your right to compensation if we breach our obligations.

Statutory guarantee of conformity

If you are a consumer, contact contact@makeshort.io to claim under the statutory guarantee of conformity for digital services. The notice below explains your rights.

The statutory guarantee of conformity applies to any lack of conformity arising during the continuous supply of the service: for a monthly plan, during each monthly supply period, including renewals; for an annual plan, during each annual supply period, including renewals. It also applies to the free plan during its supply period, under the conditions laid down by law. During the relevant period, you need only establish that the defect exists, not when it first appeared.

During those same periods, we must provide the updates needed to maintain conformity and bring the service into conformity without undue delay after your request, at no cost and without significant inconvenience to you.

You may obtain a price reduction while keeping the service, or end the contract and receive a full refund when you give up the service, in the following cases:

  1. we refuse to bring the service into conformity;
  2. conformity is delayed without justification;
  3. conformity cannot be achieved without charging you;
  4. conformity causes you significant inconvenience;
  5. the defect remains after an unsuccessful attempt to restore conformity.

If the defect is sufficiently serious, you may immediately request a price reduction or end the contract without first requesting conformity. If the defect is minor, ending the contract is available only where the contract does not require payment of a price.

Any period during which the service is unavailable to restore conformity suspends the remaining guarantee period until the service is supplied in conformity again. These rights arise under articles L. 224-25-1 to L. 224-25-31 of the French Consumer Code. Obstructing their exercise in bad faith may lead to a civil fine of up to €300,000 or 10% of average annual turnover (article L. 242-18-1).

You also benefit from the statutory guarantee against hidden defects for two years after discovering the defect (articles 1641 to 1649 of the French Civil Code). It entitles you to a price reduction if you keep the service or a full refund if you give it up.

Personal data

The processing of personal data is described in our privacy policy, which forms an integral part of the contractual information. It specifies the data collected, its purposes, the processors involved, retention periods, and your rights under the GDPR.

For accounts created from October 13, 2026, you accept at sign-up MakeShort’s usage measurement and the recording of your browsing in the app (replay) to improve the service, as stated at sign-up. The app has no off switch: to stop replay, you must delete your account (Settings). Details, retention periods and the situation of older accounts are in the privacy policy.

Changes to the Terms

The version of the Terms accepted when you subscribed governs your contract, subject to subsequent lawful changes. We may propose changes to reflect developments in the service or applicable rules. For a substantial change, we will inform you in advance on a durable medium such as email of its content, reason, effective date and any rights to refuse or terminate. Changes take effect as permitted by law.

Governing law and jurisdiction

These Terms are governed by French law. If you are a consumer, this choice does not deprive you of mandatory protections under the law that would apply without this choice. You may bring a claim before any court with jurisdiction under the rules applicable to your contract, including consumer protection rules. Seeking an amicable solution does not remove your right to judicial recourse.

Contact

For any question about these Terms, you can write to contact@makeshort.io.

These Terms are available in French and English. The two versions are intended to have the same meaning. If they differ, the French version prevails only to the extent permitted by applicable law. If you are a consumer, any ambiguity will be interpreted in your favour, and this language clause does not restrict any mandatory rights or protections available to you. Read the French Terms of Service.
